On November 20, 2012, my daughter Kelly Hyman, of Searcy Denny (West Palm Beach), McDivitt Law Firm (Colorado), Franklin D. Azar & Associates (Colorado) sued me in connection to her claimed ownership interest in the Miami Beach house that I purchased and have lived in since 2005. As we approach the eighth year anniversary of my daughter’s first attempt to steal my home, I thought it would be a good opportunity to summarize the events in a chronological timeline and provide some important updates.
On December 17, 2012, my attorney filed a motion to disqualify Kelly Hyman’s attorney, Bernardo Burnstein (Burnstein & Associates) from serving as counsel. This motion was based on the fact that Mr. Burnstein had previously been involved in legal action in regard to the purchase of my home in 2005. During those proceedings, Mr Burnstein was privy to lengthy, privileged discussions with me which put him in a direct conflict-of-interest position to represent my daughter in her attempt to take my home.

On May 6, 2013 – Judge John W. Thornton, JR denies motion to disqualify.
On March 16th, 2013, Kelly, and her Federal Judge husband Paul G. Hyman visited my property to give notice of their intent to evict me from my own home. They posted a letter and illegal eviction notice on my house:
On the same day (March 16, 2013), one of my tenants who was renting an apartment behind my house called the police on Kelly Hyman for attempting to enter her apartment without permission. Kelly had demanded that the tenant start paying rent directly to her since she was “the owner of the property”. The police officer who responded suggested that I seek a restraining order against Kelly until the property dispute was resolved. Here is the officer’s case report summary:
March 28, 2013 – My Confidential Mediation Statement is presented.
April 29, 2013 – Kelly Hyman demands payment of rent from a tenant living in one of the apartments adjacent to my home. She threatens to evict the tenant if the tenant does not comply.
August 19, 2013 – The mortgage loan officer at Colonial Bank who processed my loan for the purchase of my house testifies in front of the court that she had never dealt with Kelly Hyman directly.

“You know Ms. Hyman, you know, sometimes, I got to tell you, I know what you did and what you folks put on paper and what happened in Mr. Engelman’s office. There are certain things that I believe that you told the truth about, and there are also certain things that I think that you either lied about or are mistaken about. . . Ms. Hyman, I’m not convinced you went into this thing believing that you are the owner of Bougainvilla.”
November 17, 2014 – Judge Thornton Rules against Kelly Hyman.
“The Court finds that Ms. Hyman has tendered insufficient evidence to support her contention that she is the 100% owner of Bouganvilla. The Court determines that based on all the evidence received, Kelly Daoud Hyman is not the 100% owner of Bouganvilla Investments, Inc., as that was not the intention of the parties when the corporation was initially organized. Accordingly, the Court finds the shares Ms. Hyman issued to herself in 2013 are invalid and the same are hereby canceled.”

April 7, 2015 – Kelly Hyman’s attorney Bernardo Burstein filed a motion to Compel Compliance with Florida Statute §607.1602.This statute entitles shareholders to inspect and copy records of a corporation, including, but not limited to, accounting records of the corporation and any other books and records of the corporation.
Burstein argued in his motion that the defendant Alex Daoud refused to provide Kelly Hyman with the requested document. Burstein, in his motion, even mentioned Tragic Mess.
“Mr. Daoud’s animus towards his daughter is obvious, and it is clear that Mr. Daoud would take any steps that he can to burden Ms. Hyman and cause her injury. For example, Mr. Daoud has published a website (www.tragicmess.com), the purpose of which is to embarrass, defame, and humiliate his daughter.”

March 23, 2016 – Kelly “Not Credible” Hyman Loses Again
Kelly Hyman lost the appeal filed with the Third District Court of Appeals. On March 23, 2016, State of Florida Third District Court of Appeals concluded:
“In this case [Hyman v. Daoud], the trial court accomplished precisely what it was authorized to do by statute, and precisely what it was called upon to do by the parties: to declare the ownership structure of the Corporation. Affirmed.”
The Court of Appeals affirmed the trial court’s “extensive” and “well-reasoned” decision.

January 18, 2017 – Kelly Hyman’s appeal is DENIED.Florida Supreme Court denies petition for review of case!

July 30, 2018 – Kelly Hyman gets featured in the “Hall of Shame” on the expose website “Shameful Productions”.
2018 – Kelly Hyman bounces from one law firm to another to another. She finally lands at Franklin D. Azar & Associates (Colorado) and focuses on consumer class action lawsuits.
In an attempt to cover up her greed and past poor behavior in these matters, Kelly Hyman hires a reputation management firm to build a series of websites praising Kelly Hyman’s character and experience. The intent of this reputation rehab campaign is to suppress all of the bad press and attention Kelly Hyman received during the whole fiasco of attempting to steal her father’s home. The reputation management firm made repeated requests to have several YouTube and Vimeo videos removed that contain content of public record. All of these attempts have failed.

February 26, 2019 – Kelly holds herself out to be a “Social Justice Attorney”. It doesn’t get much more ridiculous than this. You can see the video of her on the Laura Ingraham show on Fox News attempting to provide some balance to a very conservative slanted debate on late-term abortions. She is completely ineffective and obviously outgunned by Dinesh D’Souza during the interview. D’Souza completely shuts her down. Thus, Hyman’s appearance on the show added nothing to the debate. What exactly does she mean when she says that there are already “books on the law”? Did she meant to say “laws on the books”? Who knows. But, whatever… It didn’t make sense in the context of the discussion either way.
